Kentucky Lemon Law Overview
Kentucky’s lemon law protections are established in KRS 367.840 to 367.844, which are designed to protect consumers who purchase or lease new motor vehicles that fail to conform to applicable warranties. The statutes outline manufacturer obligations, consumer remedies, dispute procedures, and limitations.
Purpose and Scope
Under KRS 367.840, Kentucky’s lemon laws are to be liberally construed to protect consumers. The purpose of the statutes is to:
- Hold manufacturers accountable for nonconformities,
- Limit the number of repair attempts,
- Require manufacturers to provide a refund or replacement vehicle when they fail to cure defects within statutory limits.
These laws apply to new motor vehicles purchased or leased in Kentucky.
Definitions
Under KRS 367.841, key definitions include:
Buyer
Residents who buy, contract to buy, or lease new motor vehicles in Kentucky.
Manufacturer
Entities that manufacture or assemble new motor vehicles sold in Kentucky.
Motor Vehicle
Excludes:
- Motorcycles
- Mopeds
- Motor homes
- Farm tractors
- Vehicles with more than two axles
- Vehicles substantially altered after the initial sale
Nonconformity
A failure to conform to an express warranty that substantially impairs the vehicle’s use, value, or safety.
Consumer Remedies
Under KRS 367.842, if a manufacturer or its agents cannot repair a nonconformity after a reasonable number of attempts during the first 12,000 miles or 12 months (whichever comes first), the consumer may choose between:
Replacement
A comparable new motor vehicle.
Refund
A full refund of the purchase price, including:
- Sales tax
- License fees
- Registration fees
- Other official charges
minus a reasonable allowance for use.
The statute also provides manufacturer defenses when:
- The nonconformity does not substantially impair the vehicle, or
- The defect resulted from abuse, neglect, or unauthorized modifications by the consumer.
Presumption of Reasonable Repair Attempts
Under KRS 367.842, a reasonable number of attempts is presumed when:
- The same nonconformity has been repaired four or more times without resolution, or
The vehicle has been out of service for repairs for a cumulative total of 30 calendar days during the warranty period.
Dispute Resolution
Disputes regarding refunds or replacement remedies must first be addressed through:
- The dispute resolution system established under KRS 367.860 to 367.870, or
- A procedure complying with 16 C.F.R. Part 703,
before seeking judicial relief.
Limitations and Attorney’s Fees
Under KRS 367.842:
- Actions must be filed within two years of the vehicle’s original delivery date.
Courts may award reasonable attorney’s fees to prevailing plaintiffs.
