Kansas Lemon Law Overview
Kansas provides consumer protection for defective new motor vehicles through K.S.A. 50-645, which establishes repair obligations, replacement or refund remedies, dispute resolution requirements, and enforcement authority.
Scope of the Kansas Lemon Law
Under K.S.A. 50-645(a), Kansas’s lemon law applies to:
- New motor vehicles sold or leased in Kansas
- Vehicles with a gross weight of 12,000 pounds or less
It does not apply to:
- Customized parts added by converters
Manufacturer’s Duty to Repair
Under K.S.A. 50-645(b):
A manufacturer or dealer must repair the vehicle to conform to applicable warranties if the consumer reports the defect within:
- The warranty period, or
- One year from the date of delivery,
whichever occurs earlier.
Manufacturer’s Duty to Refund or Replace
Under K.S.A. 50-645(c):
If the manufacturer cannot repair the vehicle after a reasonable number of attempts, the consumer is entitled to one of the following:
Replacement
A comparable motor vehicle.
Refund
The purchase price, including:
- Collateral charges
minus a reasonable allowance for use.
Reasonable Number of Repair Attempts
Under K.S.A. 50-645(d), a reasonable number of attempts is presumed if:
- The same defect has been repaired four or more times,
- The vehicle has been out of service for repairs for 30 or more cumulative days, or
There have been 10 or more repair attempts for substantial defects.
Informal Dispute Settlement
Under K.S.A. 50-645(e):
- Consumers must first use any informal dispute settlement procedure established by the manufacturer that complies with federal regulations before seeking a replacement or refund.
Enforcement Authority
Under K.S.A. 50-645(f):
The Kansas Attorney General has enforcement authority over the Kansas lemon law.
