Illinois Lemon Law Overview
Illinois provides several layers of consumer protection for defective vehicles and farm implements through three primary statutes: the Illinois New Vehicle Buyer Protection Act, the Consumer Fraud and Deceptive Business Practices Act (Used Vehicles), and the Farm Implement Buyer Protection Act. These laws establish a framework for repairs, refunds, replacements, and notification requirements.
Illinois New Vehicle Buyer Protection Act (815 ILCS 380/3)
Under 815 ILCS 380/3, new vehicles that fail to conform to express warranties after a reasonable number of repair attempts qualify for lemon law remedies.
Consumers are entitled to either:
Replacement
A vehicle of like model line or a comparable vehicle.
Refund
The full purchase price, including collateral charges, minus a reasonable allowance for use.
A reasonable number of repair attempts is presumed if:
- The same nonconformity has been repaired four or more times, or
- The vehicle has been out of service for repairs for 30 or more business days.
The manufacturer must also receive prior written notification of the defect and be given an opportunity to correct it, as required by 815 ILCS 380/3(h).
Illinois Consumer Fraud and Deceptive Business Practices Act – Used Motor Vehicles (815 ILCS 505/2L)
Under 815 ILCS 505/2L, licensed used motor vehicle dealers must provide an implied warranty of merchantability for:
- 15 days, or
- 500 miles,
whichever occurs first.
This implied warranty guarantees:
- The vehicle is fit for ordinary transportation, and
- The vehicle is free of defects in powertrain components.
The warranty cannot be disclaimed, modified, or excluded during the warranty period (815 ILCS 505/2L(c)).
If the warranty is breached, the consumer must:
- Notify the seller within two business days after the warranty period ends, and
Provide the seller an opportunity to repair the defect (815 ILCS 505/2L(f)).
Illinois Farm Implement Buyer Protection Act (815 ILCS 340/4)
Under 815 ILCS 340/4, farm implements that fail to conform to express warranties are also protected.
If the manufacturer cannot repair the defect after:
- Four repair attempts, or
- The implement is out of service for 30 or more business days,
the consumer is entitled to:
Replacement, or
Refund, minus a reasonable allowance for use.
The manufacturer must receive prior written notification of the defect and is granted 30 business days to cure it (815 ILCS 340/4(a)).
