Idaho Lemon Law Overview
Idaho’s lemon law protections are outlined in Title 48, Chapter 9 of the Idaho Code, which establishes the manufacturer’s obligations to repair, refund, or replace defective new motor vehicles. The law provides clear definitions, procedures, consumer protections, and restrictions on resale of returned vehicles.
Manufacturer’s Duty to Repair
Under I.C. § 48-902, if a new motor vehicle does not conform to applicable express warranties:
- The manufacturer, its agent, or an authorized dealer must make necessary repairs.
- This duty applies if the defect is reported during:
- The warranty term,
- Within two years of delivery, or
Before 24,000 miles, whichever occurs first.
Manufacturer’s Duty to Refund or Replace
Under I.C. § 48-903:
If the manufacturer cannot conform the vehicle to the warranty after a reasonable number of repair attempts, the manufacturer must provide one of the following:
Replacement
A comparable new motor vehicle.
Refund
A refund of the purchase price, including:
- Sales tax
- License fees
- Registration fees
- Towing expenses
- Other incidental costs
A reasonable allowance for the consumer’s use of the vehicle may be deducted.
Presumption of Reasonable Repair Attempts
Under I.C. § 48-903, a reasonable number of attempts is presumed if:
- The same defect has been repaired four or more times and still exists, or
The vehicle has been out of service for repairs for a cumulative total of 30 or more business days.
Alternative Dispute Settlement Mechanism
Under I.C. § 48-906:
- Manufacturers must operate or participate in an informal dispute settlement mechanism that meets federal standards.
- Consumers must use this mechanism before filing a civil action, unless the manufacturer waives the requirement.
Resale or Re-Lease of Returned Vehicles
Under I.C. § 48-905:
Vehicles returned under Idaho’s lemon law cannot be resold or re-leased in the state unless:
- The manufacturer provides a 12-month or 12,000-mile warranty, and
- The manufacturer provides a written disclosure describing the vehicle’s history.
Additionally:
Vehicles with unresolved braking or steering defects that could cause serious injury cannot be resold under any circumstances.
Consumer Protections
Under I.C. § 48-903, consumers are entitled to:
- Written notice of their lemon law rights,
- Access to arbitration or informal dispute procedures, and
- Remedies when a defective vehicle cannot be brought into conformity with the warranty.
