Connecticut Lemon Law Overview
Connecticut’s lemon law protections apply to new motor vehicles that fail to conform to their express warranties, as governed by C.G.S.A. §§ 42-179 through 42-190 and related regulations. These laws provide repair obligations, refund or replacement remedies, arbitration procedures, disclosure requirements for reacquired vehicles, and protections for leased vehicles.
New Motor Vehicle Warranties
Under C.G.S.A. § 42-179(b):
- If a new motor vehicle does not conform to applicable express warranties, and the consumer reports the issue within two years of delivery or 24,000 miles, whichever comes first, the manufacturer must repair the vehicle to conform to the warranty.
If the manufacturer cannot repair the vehicle after a reasonable number of attempts, C.G.S.A. § 42-179(d) entitles the consumer to:
- A replacement vehicle, or
- A refund, including:
- The full contract price
- Collateral charges
- Incidental damages
- Minus a reasonable allowance for use
Presumption of Reasonable Repair Attempts
Under C.G.S.A. § 42-179(e), a reasonable number of repair attempts is presumed if:
- The same defect has been repaired four or more times, or
- The vehicle is out of service for 30 or more cumulative days during the warranty period
Arbitration Procedures
Under C.G.S.A. § 42-181(a), the Department of Consumer Protection offers an independent arbitration process for disputes involving nonconforming vehicles.
- Consumers may initiate arbitration if the manufacturer does not operate an informal dispute settlement procedure certified by the Attorney General (C.G.S.A. § 42-181(b)).
- Arbitration decisions are binding and may award:
- Replacement
- Refunds
Reimbursement for expenses (C.G.S.A. § 42-181(d))
Disclosure Requirements for Resale of Returned Vehicles
Under Regs. Conn. State Agencies §§ 42-179-7 and 42-179-8:
- Vehicles reacquired due to defects must have a disclosure statement affixed to the windshield and included in the sales contract, stating that the vehicle was replaced or refunded due to defects.
- This disclosure statement can only be removed after the defect is certified as corrected by an appropriate engineering report and approved by the Commissioner of Motor Vehicles.
Manufacturer’s Informal Dispute Settlement Procedures
Under C.G.S.A. § 42-182(a):
- Manufacturers may establish informal dispute settlement procedures, but these must meet federal requirements and be certified by the Attorney General.
- If a certified procedure exists, consumers must use it before seeking lemon law remedies such as a refund or replacement.
New Automobile Warranties Account
Under C.G.S.A. § 42-190(a)-(d):
- A $3 surcharge is imposed on the sale or lease of every new motor vehicle.
- This surcharge funds the administration of Connecticut’s lemon law program.
Leased Vehicles
Under C.G.S.A. § 42-179(a)(1):
- Lemon law protections extend fully to leased vehicles.
- Lessees are entitled to the same warranty remedies as purchasers.
