Alabama Lemon Law Overview
Alabama provides statutory protections for consumers who purchase new motor vehicles that fail to conform to their warranty. The state’s Motor Vehicle Lemon Law outlines manufacturer obligations, consumer rights, and procedures for enforcing those rights. Additional consumer protections exist through Alabama’s Assistive Devices Warranty Act.
Manufacturer Obligations Under Alabama’s Motor Vehicle Lemon Law
Under Ala. Code 1975 § 8-20A-2, manufacturers are required to repair any nonconforming condition reported during the lemon law rights period.
The lemon law rights period is defined by Ala. Code 1975 § 8-20A-1 as:
- One year after the vehicle’s original delivery, or
- The first 12,000 miles of operation,
whichever occurs first.
If the manufacturer cannot correct the defect after reasonable attempts, the consumer may choose:
- A replacement vehicle, or
- A refund that includes:
- The full contract price
- Collateral charges
- Finance charges
- Incidental damages
- Minus a reasonable allowance for use
- The full contract price
Consumer Cause of Action Against Manufacturer
Under Ala. Code 1975 § 8-20A-3, a consumer may bring a civil action if the manufacturer fails to comply with its lemon law duties.
Before filing suit, the consumer must:
- Notify the manufacturer of the nonconforming condition, and
- Provide a final opportunity to cure the defect.
If the manufacturer fails to remedy the issue, the consumer may recover damages, including reasonable attorney’s fees.
Title Branding for Lemon Law Buybacks
Alabama requires disclosure when a vehicle has been repurchased under the lemon law.
Under Ala. Admin. Code r. 810-5-75-.47, the vehicle’s certificate of title must include the statement:
“THIS VEHICLE WAS RETURNED TO THE MANUFACTURER BECAUSE IT DID NOT CONFORM TO ITS WARRANTY.”
This ensures transparency in subsequent sales of the vehicle.
Assistive Devices Warranty Act
Although not specific to motor vehicles, Alabama’s Assistive Devices Warranty Act provides similar protections.
Under Ala. Code 1975 § 8-39-4:
- If an assistive device cannot be repaired after reasonable attempts, the consumer may request a refund or replacement.
- Refunds include:
- The full purchase price
- Finance charges
- Sales tax
- Collateral costs
- Minus a reasonable allowance for use
- The full purchase price
This statute reflects Alabama’s broader approach to consumer protection for defective products.
