Colorado Lemon Law Overview

Colorado’s lemon law protections are outlined in Title 42, Article 10 of the Colorado Revised Statutes. These laws provide remedies for consumers who purchase motor vehicles with defects that cannot be repaired after a reasonable number of attempts. The statutes define when a vehicle qualifies as a lemon, establish repair attempt presumptions, and outline consumer remedies and procedural requirements.

Definition of a Lemon

Under C.R.S.A. § 42-10-103(1), a motor vehicle is considered a lemon if it has a defect or condition that:

  • Substantially impairs its use,

  • Substantially impairs its market value, or

  • Substantially impairs its safety,

and the defect cannot be repaired after a reasonable number of attempts.

Reasonable Number of Repair Attempts

A presumption of reasonable repair attempts arises under C.R.S.A. § 42-10-103(2)(a) when any of the following occur within the first 24,000 miles or two years after delivery, whichever comes first:

  • The same defect has been subject to repair three or more times, and the defect persists;

  • The vehicle has been out of service for repair for a cumulative total of 24 or more business days;

A safety-based defect has been subject to two or more repair attempts, and the defect persists.

Consumer Remedies

If the defect is not corrected after a reasonable number of repair attempts, C.R.S.A. § 42-10-103(1) requires the manufacturer to provide one of the following remedies:

  • Replace the vehicle with a comparable motor vehicle, or

  • Refund the full purchase price, including:

    • Sales tax

    • License fees

    • Registration fees

The refund may be reduced by a reasonable allowance for the consumer’s use of the vehicle.

Notification Requirements

Under C.R.S.A. § 42-10-103(2)(c):

  • The consumer must notify the manufacturer in writing by certified mail of the defect;

The manufacturer must be provided 10 business days to cure the defect before the statutory presumption of reasonable repair attempts applies.

Attorney Fees

Under C.R.S.A. § 42-10-103(3), the prevailing party in any action brought to enforce the lemon law is entitled to reasonable attorney fees.

Exclusions

The Colorado lemon law does not apply to the following vehicles (C.R.S.A. § 42-10-101(2)):

  • Motor homes

  • Vehicles designed to travel on three or fewer wheels

Vehicles modified for commercial use

What Are Your Consumer Rights under Colorado Lemon Law?

In Colorado, lemon laws apply to new motor vehicles, including cars, trucks, and SUVs. They do not apply to used, leased, non-consumer, motorcycles, or motorhome vehicles.

The law states that if a manufacturer cannot repair a defect in your vehicle within four attempts or it has been out of service for 30 days, you may be entitled to a refund, replacement vehicle, or cash compensation.

Additionally, if it is within six months of the warranty expiring or within one year of the delivery date of the vehicle to the consumer, you may recover compensation if the dealer cannot fix the vehicle after at least two repair attempts for a serious safety defect.

What Are Eligibility Requirements For Lemon Law Claims in Colorado?

For Colorado law to consider a vehicle a lemon, it must meet specific requirements, including but not limited to:

  • Nonconformity issues: Whether minor or significant, the defect must impair the use or value of the vehicle.
  • Number of repair attempts: Colorado law requires a manufacturer to make at least four attempts to fix the defect before it can be considered a lemon.
  • Time out of service: If your vehicle has spent significant time in the shop for repairs – specifically business 30 days during the warranty period – Colorado law may consider it a lemon.

In addition to these criteria, your car must meet the following conditions for recovering compensation under lemon laws in Colorado:

  • The vehicle must be purchased within the state of Colorado
  • You must have reported the issue to the manufacturer or dealer in writing
  • The vehicle cannot hold more than 10 persons at a time
  • The vehicle must be a new and not used purchased
  • The defect must have occurred within the first year of ownership or the warranty period

How Much Do We Charge? Who Pays Attorney Fees?

The law provides that if the buyer proves a manufacturing defect with vehicle that the manufacturer is liable for the buyers’ attorney fees.

Part of our investigation and evaluation process is to identify manufacturing defects. When we proceed, we are confident we can prove a manufacturing defect. Thus, we seek our attorney fees from the manufacturer.

If a settlement can be reached, the fees will be part of the settlement agreement. If the case goes to trial, the fees will be part of a verdict or order. Either way, you are not required to pre-pay fees, pay a retainer or pay fees in the event we fail to make a recovery on your behalf.

What is the Magnuson–Moss Warranty Act?

The Magnuson–Moss Warranty Act is a United States federal law (15 U.S.C. § 2301 et seq.) that governs warranties on consumer products. The law does not require any product to have a warranty (it may be sold “as is”), but if it does have a warranty, the warranty must comply with this law. The law was created to fix problems as a result of manufacturers using disclaimers on warranties in an unfair or misleading manner and provides consumers with remedies for violation of express and implied warranties.

What is the Unfair Trade Practices Act?

Any person who suffers any ascertainable loss of money or movable property, corporeal or incorporeal, as a result of the use or employment by another person of an unfair or deceptive method, act, or practice declared unlawful by R.S. 51:1405, may bring an action individually but not in a representative capacity to recover actual damages.
