Indiana Lemon Law Overview
Indiana’s lemon law protections are established under Indiana Code § 24-5-13-15, which provides remedies for consumers who purchase or lease new motor vehicles that fail to conform to the manufacturer’s express warranty. The statute outlines what constitutes a reasonable number of repair attempts and addresses extensions of repair periods as well as the manufacturer’s burden of proof.
Reasonable Number of Repair Attempts
Under IC 24-5-13-15(a), a reasonable number of attempts to correct a nonconformity is presumed when:
- The nonconformity has been subject to repair at least four (4) times by the manufacturer, its agents, or authorized dealers, and the nonconformity continues to exist; or
- The vehicle is out of service for repair of any nonconformity for a cumulative total of at least thirty (30) business days, and the nonconformity continues to exist.
These thresholds determine when the manufacturer is considered to have had sufficient opportunity to cure the defect.
Extension of Repair Period
Under IC 24-5-13-15(b):
- The 30-business-day repair period may be extended if repair services are unavailable due to events such as:
- Strikes
- Civil unrest
- Natural disasters
- Acts of God
- Acts of war
If an extension applies, the manufacturer must provide or arrange for the free use of a vehicle for the buyer during the period when repairs cannot be performed.
Burden of Proof
Under IC 24-5-13-15(c):
- The manufacturer bears the burden of proving that the reason for any extension was the direct cause of the failure to cure the nonconformity during the qualifying event.
This ensures that extensions are not applied unless the delay was genuinely unavoidable due to the listed circumstances.
